2. This Miscellaneous petition is filed to condone the delay of 393 days in filing the appeal. When the matter was taken up for hearing on 04.07.2024, this Court dismissed the above C.M.P. and consequently, rejected the main writ appeal. However, before signing the order, it is seen that this petition needs consideration and arguments have to be heard. Therefore, this Court directed to list the matter under the caption 'for clarification'. Therefore, the matter is listed today under the caption 'for clarification'.

3. Considering the submissions made on either side and taking into account that the affected persons are workmen and the Regional Provident Commission has filed the appeal along with the condone

delay petition, we are of the opinion that the delay has to be condoned, however, on payment of costs. Accordingly, the delay is condoned on payment of cost of Rs.2,000/- (Rupees Two Thousand only) by the petitioner to the Tamilnadu Legal Aid Services Authority, Chennai, on or before 24.07.2024. If the cost is paid on or before 24.07.2024, this petition stands allowed and the Registry is directed to number the main appeal, if otherwise, in order and post it for admission on 24.07.2024. If the cost is not paid on or before 24.07.2024, this C.M.P. stands dismissed without any reference to this Court.
