Prima facie we do not consider the explanation offered on behalf of the State to be satisfactory. This petition therefore could be dismissed, however we have attempted to explore if there is anything worth being done, so far main appeal is concerned. Viewing the matter from this angle, we find that even if the delay is to be condoned, the other side need not be called upon, for the reasons which we intend to record on the main appeal. 5.

This petition is allowed and the main appeal is taken up for hearing.
