Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the fourth respondent to forward the application dated 30.01.2024 to the 2nd and 3rd respondents which has been given by the petitioner for disbursement of the 1/4

subsistence allowance, within timeframe that may be fixed by this Hon'ble Court.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the fourth respondent to forward the application dated 30.01.2024 to the respondents 2 and 3 which has been given by the petitioner for disbursement of the subsistence allowance, within a time frame.

2.The learned counsel appearing for the petitioner would submit that the petitioner was served with charge memorandum and was kept under suspension till the passing of the final order qua 07.03.2024. The learned counsel would further submit that no subsistence allowance was paid during her suspension period. In this connection, the petitioner has sent application on 30.01.2024 and such application is yet to be considered by the fourth respondent. 3.The learned counsel appearing for the fourth respondent 2/4

strongly objected the contention raised by the learned counsel appearing for the petitioner, however, would fairly submit that the petitioner's application dated 30.01.2024 would be considered within a reasonable time frame.

4.In such view of the matter, without going into the merits of the case, this Court deems it appropriate to direct the respondents 1 to 4 to consider the above application of the petitioner upon its own merits and in accordance with law and pass orders, within a period of eight weeks from the date of receipt of a copy of this order. 5.The writ petition is disposed of.
