O R D E R

The present criminal original petition has been filed seeking a direction to the second respondent police not to harass the petitioner without due process of law.

2. In the petition, it is stated that the petitioner is working as a scavenger in the second respondent Department. She joined in the year 1989 as daily wager and the first respondent confirmed the petitioner as a permanent employee. Now she is working for more than a period of 28 years. She has

studied upto fifth standard. While so, the second respondent is harassing the petitioner without any reasons. Hence, the petitioner lodged a complaint on 03.11.2015 with the first respondent. But, the first respondent has not taken any steps to enquire the matter. Hence, he has come forward with the present petition.

3. The Learned Additional Public Prosecutor submitted that at the time of appointment it appears that she has given the certifcate as if he studied upto fifth standard. Hence, complaint was lodged by the second respondent to the first respondent and only for the purpose of enquiry she has been called for and there is no intention on the part of the first respondent to harass the petitioner. But, the learned counsel appearing for the petitioner denies the same and submitted that the second respondent is harassing the petitioner.

4. In view of the said submissions made by either side, this Court is constrained to pass the following order:- (i) The petitioner is directed to cooperate with the enquiry with the respondent police.

(ii) The first respondent is also directed to conduct enquiry in accordance with law, without any harassment to the petitioner.

5. The criminal original petition is ordered accordingly.
