O R D E R

This petition has been filed to direct the 2nd respondent to register a case based on the complaint given by the petitioner dated 28.04.2018.

2.The learned counsel for the petitioner has submitted that the proposed accused persons have created certain documents with regard to the petitioner's property and hence the petitioner has lodged a complaint before the second respondent. Based on the said complaint, a case in Crime No.517 of 2018 was registered. He has further submitted that after registering the said case, the proposed accused persons have trespassed into the petitioner's land and cut trees worth about a sum of Rs.2,00,000/- and taken away and with regard to the said incident also, the petitioner has lodged a complaint before the https://hcservices.ecourts.gov.in/hcservices/

second respondent police on 28.04.2018, but so far, no action has been taken.

3. The learned Additional Public Prosecutor has submitted that, since already a case was registered in Crime No.517 of 2018, no action has been taken on the second compliant.

4. Considering the aforesaid submissions, since the second complaint is relating to some other occurrence, the respondent has to enquire the said complaint and if the enquiry reveals any cognizable offences then he has to register a case and proceed further in accordance with law. In case, the enquiry reveals only a civil dispute, the second respondent has to direct the petitioner to approach the appropriate forum and get appropriate relief in accordance with law.

5. With the aforesaid direction, this petition is disposed of.
