C.M.P.Nos.14000 and 14003 of 2021 in A.S.S.R.No.27841 of 2021 PUSHPA SATHYANARAYANA, J.

C.M.P.No.14000 of 2021 is filed seeking to recognize the appellants 2 to 7 as the legal heirs of the first appellant, viz., K.Ponnammal, who are all ready on record in the above appeal.

2. C.M.P.No.14003 of 2021 is filed seeking to implead Kalarani Sivasubramaniam, as the legal heir of late Sivasubramaniam (5th appellant), who passed away on 13.05.2021, as the 8th appellant in the above appeal.

3. The said Sivasubramaniam (5th appellant) died on 13.05.2021 leaving behind his wife, viz., Kalarani Sivasubramaniam and his daughters, viz., Akilandeeswari and Shalini as his legal heirs.

4. The learned counsel for the petitioners/appellants had expressed difficulty in impleading the daughters, Akilandeeswari and Shalini as legal heirs of the deceased fifth appellant, as they are living in United States of

America and now, for the present, he is impleading only the wife of the deceased, viz., Kalarani Sivasubramaniam, as legal heir of the deceased fifth appellant.

5. Upon hearing the submission made by the learned counsel for the petitioners/appellants and on being satisfied with the reasons stated in the affidavit filed in support of the petition, C.M.P.No.14003 of 2021 is ordered. Liberty is given to the petitioners/appellants to implead the daughters, Akilandeeswari and Shalini as legal heirs of the deceased Sivasubramaniam, at a later point of time.

6. Since the appellants 2 to 7 are already on record as the legal heirs of the first appellant, viz., K.Ponammal in the above appeal, C.M.P.No.14000 of 2021 filed seeking to recognize the appellants 2 to 7 as the legal heirs of the first appellant, is ordered as prayed for.
