Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to modify the condition "The petitioner shall execute a bond for 5 lakhs" imposed by the Hon'ble Mahila Court, Chennai, order dated 26.06.2018 in Crl.M.P.No.9618 of 2018 in SC.214/17.

O R D E R

This petition has been filed to modify the condition imposed by the Sessions Judge, Mahila Court, Chennai in Crl.M.P.No.9618 of 2018 in S.C.No.214/17 dated 26.06.2018.

2. The learned counsel for the petitioner has submitted that the petitioner's Swift Dzire Car bearing registration No.TN 07 CB 6307 has been seized by the respondent police and produced before the Sessions Judge, Mahila Court, Chennai in S.C.No.214/17.

3. He further submitted that the petitioner has filed an application in Crl.M.P.No.9618 of 2018 seeking interim custody pending trial. He further submitted that the learned Trial Judge has allowed the said application with conditions and one of the said conditions is that the petitioner shall execute https://hcservices.ecourts.gov.in/hcservices/

a bond for Rs.5,00,000/-. He further submitted that the said Car was 97% burned in the alleged occurrence and the said Car now is worth about only Rs.10,000/- to 15,000/- and therefore, the said condition may be modified.

4. The learned Additional Public Prosecutor has fairly conceded that the said Car is fully burnt and hence, she submitted that the condition may be modified.

5. Considering the aforesaid submissions, the condition passed by the Trial Court that the petitioner shall execute a bond for Rs.5 lakhs is modified to the effect that he shall execute a bond for Rs.50,000/- and the other conditions imposed by the Trial Court shall continue.

6. With the above said modifications, this Criminal Original Petition is disposed of.
