Respondents Petition filed under Article 226 of The Constitution of India, praying for the issuance of a Writ of mandamus directing the respondents to promote the petitioner for the post of B.T. Assistant (English) according to her seniority based on her representation dated 20.03.2015.

ORDER

By consent, the writ petition itself is taken up for final disposal.

2.The petitioner, after passing higher secondary examination, had undergone secondary grade teacher training conducted by the Board of Higher Secondary Examination, Tamil Nadu and during April 1991, passed B.A. (English) degree from Madurai Kamaraj University and also passed M.A. (English) degree from Manonmaniam Sundaranar University in April, 1995. During the year 2009, the petitioner was appointed as secondary grade teacher and her services were also regularised. The petitioner has also qualified herself with B.Ed. degree from the Tamil University, Thanjavur during December, 2010. The petitioner, on account of the qualification, was waiting for promotion to the post of B.T. Assistant (English) and she was placed in the fifth position.

The fourth respondent has also included the petitioner's name in the panel for promotion to the said post during the year 2012. The petitioner would state that she is placed in the fourth position in the seniority list as the promotion of the candidate at Sl.No.2 has been rejected on the ground that she has undergone one year in B.A. (English) and persons immediately above her, have been given promotion whereas the claim of the petitioner for promotion to the post of B.T. Assistant (English) is yet to be considered and in this regard, submitted representations dated 28.02.2014 to the second respondent as well as 20.03.2015 to the Honourable Minister for School Education with copies marked to the respondents and since she is yet to be favoured with response, came forward to file this writ petition.

3.Heard the submissions of Mr.A.Prakash, learned counsel appearing for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of the respondents. 4.Though the petitioner prayed for a larger relief, this Court, in the light of the facts and circumstances, directs the second respondent to consider and dispose of the petitioner's representations dated 28.02.2014 and 20.03.2015 on merits and in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
