PRAYER:

Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to consider and dispose of the representation dated .06.2013 for the purpose of issuance of chitta and adangal extracts for petitioner's lands situated in Survey No.484/1 measuring 900 sq.m. in his favour in a time bound manner.

ORDER

The prayer in the writ petition is for issuance of a writ of mandamus to direct the respondents to consider and dispose of the petitioner's representation dated nil.06.2013.

2. The case of the petitioner is that the land measuring an extent of 0.0900 sq.mt. in Survey No.484/1 in Melbhuvanagiri Village is an ancestral property of the petitioner and he was issued with patta by Special Tahsildar on 12.01.1994. The grievance of the petitioner is that there was no mutation in the Revenue Records and therefore, he approached the Village Administrative Officer, but he demanded a sum of Rs.30,000/- for changing the Revenue Records and hence, the petitioner gave a representation to the District Collector. Since no action was taken, the present writ petition.

3. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents and perused the materials available on record.

4. The learned counsel for the petitioner submitted that it would suffice, if a direction is issued to the respondents to consider the representation of the petitioner.

5. Per contra, the learned Government Advocate for the respondents submitted that the Tahsildar, Buvanagiri is the competent authority, if a representation is given to him, it would be considered in accordance with law.

6. In the light of the above submissions, the petitioner is directed to give fresh representation to the Tahsildar, Buvanagiri, within a period of two weeks by enclosing a copy of this order. On such compliance, the Tahsildar, Buvanagiri shall pass appropriate orders on merits and in accordance with law, within a period of six weeks therefrom, after providing opportunity to the necessary parties.

7. With the above observations and directions, the writ petition is disposed of. No costs.
