This petition has been filed challenging the order dated 07.02.2025 in Crl.M.P.No.10 of 2025 in S.C.No.98 of 2022 on the file of the learned II Additional District and Sessions Judge, Tiruppur, thereby dismissing the petition to recall PW.1 to PW.3 for further cross-examination.
2. Heard the learned counsel for both sides and perused the materials available on record.
3. On a perusal of the records, it is revealed that the petitioners are the accused, and they are facing trial in S.C.No.98 of 2022 for the offences punishable under Sections 294(b), 302 r/w 114, 352, and 506(2) of IPC. The prosecution had examined PW.1 to PW.14. PW.1 to PW.3 were examined on 26.09.2023. Thereafter, on 05.01.2024, they were fully cross-examined by the petitioners. Even then, once again the petitioner filed a petition to recall PW.1 to PW.3 for further cross-examination. Therefore, it is nothing but to drag on the proceedings, and as such, the Trial Court has rightly dismissed the petition filed by the petitioners, and this Court finds no grounds to 2/4
interfere with the order passed by the Trial Court.
4. Accordingly, this Criminal Original Petition is dismissed. However, the Trial Court is directed to complete the trial within a period of three months from the date of receipt of a copy of this order. Consequently, the connected Miscellaneous Petition is closed. 30.04.2025 Index:Yes/No kv To
