Heard the learned counsel for the petitioners and the learned counsel for the respondents 1 to 3 and 5 to 8.

2. Notice sent to 4th respondent in the second appeal, service held sufficient and hence this Court is of the view that no notice is necessary in these petitions.

3. The learned counsel for the petitioners submitted that the 9th respondent/Nagarajan in the second appeal passed away on 17.12.2016 leaving behind the proposed respondents 9 & 10 as his legal heirs and the 10th respondent/Murugaiyan in the second appeal passed away on 08.12.2016 leaving behind the proposed respondents 11 to 13. Accepting the reasons stated in the affidavits filed in support of these petitions, this Court is inclined to allow these petitions and accordingly these petitions are allowed.
