....Respondents This case came up for settlement before the Lok Adalat. Both the parties are present. Mr.T.G.Balachandran, the learned counsel for the Appellant and Mr.S.Arunkumar, the learned counsel for the 2nd respondent are present and no appearance on behalf of the second respondent. After mutual discussion, negotiation, mediation and
conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT Both the parties and their respective counsel are present.
2. The Tribunal has awarded a sum of Rs.5,55,500/- (Rupees Five Lakhs Fifty Five Thousand and Five Hundred only) with interest at the rate of 7.5% per annum from the date of petition till the date of realization. Aggrieved by the said award, the appellant has preferred the present appeal.
3. After due deliberation and consultation, both the parties have settled the matter and as per the settlement, the Insurance Company has agreed to pay a sum of Rs.8,00,000/- (Rupees Eight Lakhs only) over and above the Tribunal's award already passed in full quit. The Insurance Company is directed to deposit the said amount as agreed by them within a period of 4 weeks from the date of receipt of a copy of this order. On such deposit, the claimant is permitted to withdraw the said amount, without filing any formal petition.
4. The Tribunal is directed to transfer the above said award amount to the Bank account of the claimant by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition
5. The 2nd respondent/National Insurance Company Limited is directed to deposit the amount of compensation now arrived at today, less the amount already deposited, if any, within a period of four weeks. On such deposit being made, the appellant is permitted to withdraw the amount on filing proper applications.

The Court fee paid shall be refunded to the parties in the manner provided under the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w.25 of LSA Act 1987 as amended in 1994. This National Lok Adalat award is passed in terms of the above settlement.
