ORDER
The petitioner/defacto complainant has filed this petition seeking to direct the filing of a final report in Crime No. 250 of 2025.
2. The contention of the petitioner is that he had lodged a complaint against one Vijayakumar, who resides at Ayyanar Koil Street, Kosapalayam, Puducherry. Two years ago, the petitioner had given a sum of Rs. 7,00,000/- as a hand loan. When the petitioner demanded repayment, the said Vijayakumar issued a cheque for the said amount on 31.10.2025. The petitioner presented the cheque in his bank, but it was dishonoured. This was informed to the accused Vijayakumar, who then asked the petitioner to come to Ruba Vani Showroom. Accordingly, the petitioner went there on 31.10.2025 at about 8.00 p.m. Between 8.00 p.m. and 8.15 p.m., Vijayakumar and two other persons came and allegedly threatened, brutally assaulted, pushed down, and harassed the petitioner.
The entire incident was stated to have been recorded on CCTV cameras, and one of the accused is said to be the son of a woman constable. Hence, the petitioner lodged a complaint against the accused persons, and a case was registered in Crime No. 250 of 2025 for offences under Sections 115(2), 351(2), and 3(5) of the BNS Act. Since the mother of one of the assailants is a police official, no action has been taken so far, leading to the filing of the present petition.
3. The learned Public Prosecutor submitted that, based on the petitioner's complaint, a case was registered. During the course of investigation, enquiries were conducted at Ruba Vani Showroom, and CCTV footage was collected from the showroom and nearby establishments. However, no CCTV footage was available for the relevant date and time (31.10.2025 between 8.00 p.m. and 8.15 p.m.) pertaining to the alleged incident. The physical setting described by the complainant was verified. Further, the identities of the two other persons alleged to have joined Vijayakumar in attacking the petitioner could not be identified. There was no corroborative evidence of the alleged assault or criminal intimidation. It was also noted that the petitioner had already obtained a cheque for the amount of Rs.
7,00,000/-, and the alleged assault was said to have taken place thereafter. In the absence of corroborative material, the case appeared to be predominantly civil in nature. Hence, the case was closed as a "mistake of fact." An RCS notice was also served on the petitioner/complainant, and the same was acknowledged by him.
4. Considering the submissions and upon perusal of the materials available on record, it is seen that the investigation in Crime No. 250 of 2025 has been completed and the case has been closed as a "mistake of fact." An
