Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the impugned proceedings issued by the 2nd respondent in Lr.No. 022664/418/G.26/G.262/2015 dated 27/05/2015 and to quash the same and consequently direct the respondents to alter the date of birth of the petitioner in Service Records as 07/02/1959 instead of 14/04/1957 as per original birth extract and other documents submitted along with the application dated 24/06/2013 and to allow the petitioner to continue in service in the post of Assessor uptill reaching the age of superannuation as per actual date of birth with consequential benefits within a time frame to be fixed by this Court.

O R D E R

After some elaborate arguments, the learned counsel for the petitioner submitted that he may be permitted to file by way of appeal to the Chairman for reduction of punishment.

In view of the submission made by the learned counsel for the petitioner, making it very clear that this Court is not interfering with the impugned proceedings of the second respondent, the petitioner is permitted to file an appeal to the Chairman, The Tamilnadu Electricity Generation and Distribution Corporation (TANGEDCO), Chennai 600 002 within a period of 15 days from the date of receipt of copy of this order. On receipt of such appeal, the Chairman is directed to consider the same and pass appropriate order in accordance with law within a period of two months thereafter.

3. The writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
