ORDER

This petition has been filed praying to direct the respondent-Police to register a case on the complaint given by the petitioner dated 31.05.2015 and to investigate the case and file the final report within a time frame. 2.In the affidavit filed in support of this petition, it has been stated by the petitioner that she and her husband are the absolute owners of the property situated at Plot No.20, Bavani Nagar, Teachers Colony, Kolathur, Chennai. One Mr.M.Hari Raj represented that he is the Proprietor of M/s.Kudil Builders, doing the business of real estate and building constructions and offered to construct a house in the aforesaid property. Believing the aforesaid representation, a construction agreement was entered into between the petitioner https://hcservices.ecourts.gov.in/hcservices/

and the aforesaid Mr.M.Hari Raj. But, subsequently, a dispute arose between the petitioner and the said Mr.M.Hari Raj and in this regard, a suit is pending before the City Civil Court at Chennai. While so, the said Hari Raj had stolen a blank cheque of the petitioner bearing No.433423300 drawn on Indian Bank, Vivekanandar Branch, Chennai and filled the amount, by affixing the signature of the petitioner, and encashed a sum of Rs.57,000/-. In this regard, a complainant was lodged by the petitioner on 31.05.2015 with the respondent-Police; but, no action was taken by the respondentPolice. Hence, the petitioner has come forward with the present petition before this Court.

3.Heard both sides. The learned Additional Public Prosecutor submitted that the petitioner's complaint has been received by the respondent-Police in C.S.R.No.326/2015 and the enquiry is pending.

4.Considering the facts and circumstance of the case and the fact that the petitioner's complaint dated 31.05.2015 has been received by the respondent-Police in C.S.R.No.326/2015, this Court directs the respondent-Police to conduct an enquiry in C.S.R.No.326/2015 and dispose of the same, in accordance with law, as early as possible.

With the above direction, this criminal original petition is disposed of.
