O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 394 of IPC in Crime No.1265 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused person have collided with the bike of the defacto complainant, due to which he fell down from the bike. Suddenly, the petitioner along with other accused have snatched the purse of the defacto complainant, which containing the collection amount of Rs.47,000/- as well as the bike key and ran away from the scene of occurrence. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner did not commit any offence as alleged by the respondent police. Hence, he prays to grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

The learned Additional Public Prosecutor would submit that the on 25.08.2020, when the defacto complainant was going near Vijayamangalam Road, the petitioner along with other accused dashed against him and snactched a sum of Rs.57,000/- from him. The other accused (A2) is still in custody and there is no previous case pending as against this petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the serious nature of the offence alleged to have been committed by the petitioner and the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioner.
