O R D E R

The present criminal original petition has been filed seeking a direction to the 2nd respondent Police to register the FIR based on the petitioner's complaint dated 05.10.2015.

2. Though very many contentions have been made in the affidavit, the learned counsel for the petitioner submits that the petitioner lodged a complaint as against one Swetha representing the Maxpro Management, who claiming that they were in the medical and life insurance business. In the said complaint, the petitioner had stated that the Maxpro Management has collected a sum of Rs.50,000/- from the petitioner stating that they would issue medical policy in favour of the petitioner. But, after receiving the amount, no policy was issued and on enquiry, the petitioner came to know that the said Maxpro Management have cheated several persons. petitioner has given a complaint on 05.10.2015. But, till date no action was taken. Hence, the petitioner has filed the present criminal original petition.

3. The learned Additional Public Prosecutor submitted that the complaint was sent only by post and if the petitioner gives a fresh complaint, necessary action will be taken.

4. In view of the submissions made on either side, this Court directs the petitioner to give a fresh complaint along with the copy of this order before the 2nd respondent police within a period of one week from the date of receipt of a copy of this order, and on receipt of the same, the 2nd respondent is directed to conduct enquiry and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the 2nd respondent is directed to proceed further in accordance with law, as early as possible.

5. This criminal original petition is disposed of accordingly.
