Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Certiorari to call for the records pertaining to the resolution passed by the first respondent in resolution No.266/2016 dated 18.06.2016 and also consequential proceedings of the 2nd respondent in D.C.c.No.50/2017 dated 03.06.2017 and quash the same. (Order of the Court was made by M.M.SUNDRESH,J.) Challenging the Resolution No.266/2016 dated 18.06.2016 and the consequential proceeding of the second respondent in D.C.C.No.50/2017 dated 03.06.2017, the present writ petition is filed.

2. The learned counsel appearing for the petitioner would submit that the resolution is not based upon the correct facts.

3. We are afraid that the said contention cannot be accepted at this stage as the resolution was on a prima facie consideration. That is the reason why the petitioner was asked to come for the enquiry. In our considered opinion, the writ petition is premature and thus the same stands dismissed. However, we make it clear that we have not gone into the merits of the case and if the petitioner is aggrieved by the outcome of the enquiry, it is well open to him to agitate the same in the manner known to law.

No costs.

Consequently, W.M.P.No.18498 of 2017 is also dismissed.
