Ms. No 47, TWAD Estt, (Per) Wing, dated 05.06.2008 as granted to other Engineers namely Thiru J.L. Gurunathan, thiru N. Jayasankar, Thiru T.S. Sekar, and Thiru M. Antony Raja Pazham.

ORDER

The writ petition is filed for the relief set out below: "directing the Respondents to consider and pass orders on the petitioner's representation dated 16.02.2026 to include the petitioner's name in the panel of Executive Engineers found fit for promotion to the post of superintending engineer for the year 2018-2019 to restore his original seniority and to grant him notional promotion on par with his junior namely Thiru N. Udayasingh (Seniority No 925) and to release all consequential pensionary and terminal benefits as per B.P. Ms. No 47, TWAD Estt, (Per) Wing, dated 05.06.2008 as granted to other Engineers namely Thiru J.L. Gurunathan, thiru N. Jayasankar, Thiru T.S. Sekar, and Thiru M. Antony Raja Pazham."

2. It is the case of the petitioner that he joined the TWAD Board as an

Assistant Engineer on 07.12.1983. Though the name of the petitioner was included in the panel of Executive Engineers for the year 2018-2019, he was deferred due to pending charges. By proceedings dated 27.03.2019, the second respondent passed final orders discharging the petitioner from all the charges. Therefore, the petitioner submitted a representation dated 11.04.2019 seeking restoration of seniority and promotion as Superintending Engineer. Later, he attained superannuation on 31.05.2019.

3. The second respondent vide order dated 08.02.2023 rejected the petitioner's request stating that he was not fully qualified under Regulation 23(II)(2). Aggrieved by the same, the petitioner made a detailed representation dated 16.02.2026 for which there is no response till date. Therefore, the petitioner is before this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, direct the respondents to consider the petitioner's representation dated 16.02.2026, on merits and in accordance with law and to pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order.
