O R D E R

The present criminal original petition has been filed seeking a direction to the respondent Police to register a case based on the petitioner's complaint dated 20.10.2015 and investigate the same in accordance with law.

2.In the petition, it has been stated that the petitioner is a resident of Coimbatore and he is working as Junior Analyst in Cognizant Technology Solution (CTS) in Siruseri. Since the petitioner was staying in the Ladies Hostel run by one of the accused viz., Gowry in Thiruvanmiyur, the said Gowry suggested the marriage proposal with one J.Prashanth, S/o.K.Jothikumaran and J.Mallika. Subsequently, the marriage was performed on 08.06.2014 at Abinaya Mahal, Hotel Aryas, Madurai Road, Tirunelveli according to Hindu Customs and rites. Further, it is stated that the petitioner's father has given 65 sovereign of jewels at the time of petitioner's marriage to J.Prashanth as

demanded by the petitioner's in-laws through the said Gowry, who was instrumental in finalizing the marriage alliance. The allegation of the petitioner is that her in-laws have also demanded silverwares and the same were provided, which are worth about around Rs.1.75 Lakhs to 2 lakhs. Thereafter, the petitioner's in-laws insisted that his father should provide a bracelet and chain weighing about 8 sovereigns. The demand was made for expensive and luxurious Television, Refrigerator and Washing Machine and other furniture such as Dining Table, Chairs, Sofa Set and Double Cot, which are about approximately valued 5 lakhs.

Though the petitioner's in-law pretended to be kind and considerate initially, they showed their true colour after the marriage and they did not disclose about their son's premarital affairs and relationship with various women. When the petitioner questioned the same, they have harassed the petitioner. Hence, the petitioner lodged a complaint on 20.10.2015 as against her husband, in-laws and Gowri. But, till dated no action was taken. Hence, the petitioner has filed the present criminal original petition.

3. Today, when the matter was taken up for consideration, the learned Additional Public Prosecutor submitted that the petitioner's husband viz., J.Prashanth lodged a complaint on 19.10.2015, prior to the complaint of the petitioner and both the complaints are pending before the respondent police.

4. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

5. In view of the submissions made on either side, this Court directs the respondents police to conduct enquiry on both the complaints and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the respondents are directed to proceed further in accordance with law. In case, during the course of enquiry, the respondents come to the conclusion that the matter is relating to the family dispute, the respondents are directed to dispose of the said complaints by passing appropriate orders on the complaints in accordance with law, as early as possible.
