Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, to direct the 1st and 2nd respondents to survey and mark the boundaries of the land belonging to the petitioner in Villupuram District, Villupuram Taluk, Villupuram R.D, Valavanur Sub.D., Mitta Mandagapattu Village, bearing Dry Survey No.173/1 in this extent of 0.94 cents out of the total 1.12 cents having temporary Re Survey No.173/1A and 173/1B in Patta No.800 situated within kandamangalam panchayat union based on the petitioners application for the survey and marking of boundaries vide challan No.2025/0123/07/010910 dated 29.10.2025.

ORDER

This writ petition has been filed to direct the respondents to consider the petitioner's representation dated 29.10.2025.

2. Ms.Inthu Karunakaran, learned Government's counsel, takes notice on behalf of the respondents.

3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.

4. The learned counsel for the petitioner would submit that in this case, the petitioner filed a representation dated 29.10.2025 before the 1st & 2nd respondents, requesting them to survey and mark the boundaries of the subject land. However, the said representation was not at all considered by the 1st & 2nd respondents till date. Hence, this petition.

5. In reply, the learned counsel for the respondent would submit that the petitioner's representation will be disposed of within a period of 6 weeks and hence, she requests this Court to pass appropriate orders.

6. Heard the learned counsel appearing for the petitioner as well as the respondent and also perused the entire materials available on record.

7. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the 1st & 2nd respondents to consider the representation of the petitioner dated 29.10.2025 and dispose of the same, on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.

8. It is made clear that this order is passed only for the purpose of issuing a direction to the official respondent for conducting survey and laying boundary stones at the subject land at Survey No.173/1A. If there is any dispute with regard to the possession over the said property, the same has to be decided only by way of filing a suit before an appropriate Civil Court.

9. If any police protection is required at the time of conducting survey, the official respondents are granted liberty to avail the same by approaching the jurisdictional police station. In such case, the concerned police officer shall provide all necessary assistance to the official respondents till the completion of survey at the subject land.
