O.P.No.396 of 2022 O.P.No.396 of 2022 C.V.KARTHIKEYAN,J., The Original Petition filed under Section 372 of the Indian Succession Act, 1952, seeking Succession Certificate relating to the amount with Postal Life Insurance in the Postal Department, Park Town Head Post Office, Chennai in the name of S.G.Venkatasubramanian, who died intestate on 15.04.2021.
2. The 1st petitioner is his wife, the 2nd petitioner is his son and the 3rd petitioner/minor is his another son. The mother of S.G.Venkatasubramanian, had predeceased him.
3. After following due procedure, the petitioners were invited to tender evidence.
4. The 1st petitioner examined herself as P.W.1. The Death Certificate of her husband S.G.Venkatasubramanian was marked as Ex.P1, the Death Certificate of her mother-in-law/mother of S.G.Venkatasubramanian was marked as Ex.P2 and the Legal Heirship Certificate of S.G.Venkatasubramanian was marked as Ex.P3. 5. In view of the evidence recorded, the Original Petition stands allowed. Succession Certificate to be issued in the names of the 1st and 2nd petitioners.
6. The 1st petitioner is under the obligation on receipt of the amounts in the Post Office Department on behalf of the 3rd petitioner/minor to deposit 1/3rd of the amount in a Fixed Deposit and the Fixed Deposit Receipt should be produced before the Registrar of the Original Side of the Madras High Court to be kept in a safe custody, till the 3rd petitioner/minor attains the age of majority. The 1st petitioner is permitted to withdraw the interest which accrues every quarterly and use it for the benefit of the 3rd petitioner/minor. Copy of this order may also be produced before the particular Bank where the amounts was kept in Fixed Deposit, to facilitate withdrawal of the quarterly interest.
