This Petition has been filed by the CBI to modify the order dated 09.02.2022 in W.P.(Crl)No.257/2022 with respect to constitution of SIT to exclude R.Ravi, Dy.SP, CBI, SCB, Chennai from the SIT. 2.This Court by order dated 09.02.2022 in W.P.(Crl.)No.257 of 2022 in paragraph No.13(iii) issued the following direction: "(iii) The respondents 1 and 2 are directed to depute Mr.R.Ravi, Deputy Superintendent of Police, SCB, CBI, Chennai, exclusively to the SIT and he shall not be transferred until the purpose of constitution of SIT is achieved or until further orders from this court;"
3.As per the order of this Court Mr.R.Ravi, DSP, CBI, SCB, Chennai exclusively deputed to SIT, with a direction he shall not be transferred until the purpose of constitution of SIT is achieved. 4.Now the Director of CBI filed this Petition stating that since 1/5
Mr.R.Ravi, DSP, CBI, SCB, Chennai is investigating other cases entrusted by the various constitutional Court, including the Hon'ble Apex Court, the work assigned to him is greatly affected. In view of the same, he may be dispensed from SIT.
5.The learned State Public Prosecutor submitted that the formation of SIT is for the reason that the alleged occurrence in this case is 29.03.2012 and though almost 10 years have lapsed, no breakthrough could be made and therefore, earlier the case was transferred to CBCID and thereafter to CBI for better investigation. The CBI had taken up the investigation on 08.01.2018 and it was investigated by Mr.R.Ravi, DSP, from then on, he collected materials, gathered informations and also cultivated informants and in view of the same, his experience, expertise and knowledge to be used by the SIT to apprehend the accused. He also submitted the entire case records handed over by CBI on 07.03.2022 and from then on Mr.R.Ravi, DSP had been in regular interaction with the other investigating officers of SIT viz., Mr.S.Jeyakumar, Superintendent of Police, Mr.Madhan, Deputy Superintendent of Police, Ariyalur. He had shared with all the informations and materials, he had been 2/5
very cooperative and giving useful leads, his experience and expertise is very much needed and to be continued. The said Mr.R.Ravi, DSP, can be utilised by CBI to investigate other cases with a condition that as and when required by Special Investigation Team, the said Officer shall be permitted to participate without giving any other reasons, so that the investigation which is at a crucial stage is not hampered in any manner. 6.The learned counsel for CBI submitted that the Mr.R.Ravi, DSP will not be transferred as per the condition of this Court and he will continue to be member of SIT as and when required, he shall report to SIT, involve himself in the investigation.
7.In view of the same, to the extent that exclusively to SIT, this Court modifies paragraph No.13(iii) of the order dated 09.02.2022 in W.P.(Crl.)No.257 of 2022 as follows:
"(iii) Mr.R.Ravi, Deputy Superintendent of Police, SCB, CBI, Chennai, will continue to be a member of SIT and he shall not be transferred until the purpose of constitution of SIT is achieved or until further orders from this court and 3/5
Mr.R.Ravi, Deputy Superintendent of Police, SCB, CBI to participate in the SIT investigation as and when required. In the meantime Mr.R.Ravi, Deputy Superintendent of Police, SCB, CBI to attend other works entrusted to him." With regard to other conditions, the same shall continue and there is no other alteration.
8.Accordingly, this Petition is ordered. Post the main the case on 14.11.2022.
