ORDER

This writ petition has been filed challenging the order passed by the fifth respondent dated 27.02.2024, thereby rejected the request made by the petitioner to change her mother-in-law's name as Rani Natarajan from Sumathi Natarajan.

2. Heard the learned counsel on either side and perused the materials

available on record.

3. The petitioner's husband died on 27.09.2023 leaving behind the petitioner, minor daughter and her mother-in-law. The petitioner applied for death certificate of her deceased husband. She was issued with a death certificate on 11.10.2023. She found that her mother-in-law's name has been mentioned as Sumathi Natarajan instead of Rani Natarajan. Therefore, the petitioner submitted a representation to the fifth respondent to change the name of her mother-in-law as Rani Natarajan. However, the petitioner did not furnish any material to show that her mother-in-law name is Rani Natarajan. Therefore, the request made by the petitioner was rejected, on the ground that there is no provision to change the name of the person under Section 15 of the Registration of Birth and Death Act, 1969.

4. A perusal of records revealed that the petitioner did not even produce any single material to show that her mother-in-law name is Rani Natarajan. However, the learned counsel for the petitioner would submit that the petitioner has all documents to show that her mother-in-law name is Rani Natarajan.

5. In view of the above submission, the petitioner is at liberty to submit a

fresh application with all material evidence to show that her mother-in-law name is Rani Natarajan, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the fifth respondent is directed to consider the same and pass orders on merits and in accordance with law.

6. With the above directions, this writ petition is disposed of. Consequently, connected Miscellaneous petition is closed. There shall be no order as to costs.
