Respondents Petition is filed under Article 226 of The Constitution of India praying to issue a writ of Mandamus to direct the first respondent to consider the petitioner's application along with other participants for allotment of work based on the estimate rate as quoted in the e-tender application dated 27.08.2015 applied for 2 packages namely TN 11-05 Package, Veppur Block, TN-11-06 Package and Veppur Block in the tender inviting bids called for by the first respondent in the proceedings of TNRRIS/2015-16 in e-procurement notice dated 14.08.2015 without insisting the certificate which has to be issued by the 2nd respondent regarding working conditions of the equipments namely 1.Bitumen Boiler, 2. Mini Hot Mix Plant 3. Bull Dozer 4.Excavator, 5.Concrete mixers, 6. Water Tanker, 7.Water Tanker with sprinkler, 8.Diesel Road Roller (Steel Wheel) (8 to 10 tonne), 9.Tractor, 10.Loader (5 cum), 11.Tippers, 12.Vehicle Mounter Mechanical Sprayer 13. Paver Finisher and 14. Vibratory Roller.

ORDER

When the writ petition is taken up for hearing, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw the above writ petition and has also made an endorsement ot that effect.

2. Accordingly, permission is granted and the writ petition is dismissed as withdrawn. No costs.
