Dated : 25.04.2025

CORAM

THE HONOURABLE Ms. JUSTICE P.T. ASHA Paramasivam ... Petitioner Vs.

Chinnathambi @ Palaniappa Gounder ... Respondent Prayer : Civil Revision Petition filed under Article 227 of the Constitution of India, praying to direct the Principal District Munsif, Tiruchengode to dispose the REP.No.13 of 2024 within a period stipulated by this Court. For Petitioner :

Mr.E.P.Senniyangiri

ORDER

Aggrieved by the fact that the Execution Petition in REP.No.13/2024 filed by him on 18.04.2024, has not been disposed of by the Principal District Munsif, Thiruchengode, the petitioner is before this Court.

2. The notes of proceedings would clearly show that the revision petitioner/plaintiff had filed a suit in the year 2017 and after seven years, the suit came to be allowed on 16.10.2023, directing the respondent/defendant 1/4

to hand over possession of the suit property within three months. Subsequent to which, the revision petitioner has taken out REP.No.13 of 2024, in which, the case has been posted for enquiry on 09.12.2024, but to date, the enquiry has not been concluded. Thereafter, on 27.01.2025, the judgment debtor/defendant has filed a memo stating that he has filed Tr.OP.No.353/2024 seeking transfer of the said Execution Petition. However, the said Tr.OP.353/2024 was also dismissed on 24.03.2025.

3. Considering the fact that unless the execution petition is concluded in a time bound manner, the revision petitioner would not taste the fruits of justice, a direction is issued to the Principal District Munsif, Thiruchengode, to dispose of REP.No.13/2024, on or before 31.08.2025.

4. With the above direction, the civil revision petition is allowed. No costs.
