The petitioner has not surrendered before the Trial Court.
2. The leaned Counsel for the petitioner, by producing the medical records of the petitioner, submitted that the petitioner's case may be taken as an exceptional case in view of his physical condition and when this Court, on the last occasion questioned whther the petitioner would be in a position to deposit atleast a sum of Rs.2,00,000/- out of the total sum of Rs.5,00,000/- i.e., the cheque amount, the learned Counsel sought time till today to get instructions.
3. Today, when the matter came up for hearing, there is no representation for the learned Counsel for the petitioner.
4. In that view of the matter, this petition to suspend the sentence, shall stand dismissed.
5. In the meanwhile, the respondent/complainant can approach the Trial Court and the Trial Court is entitled to issue/execute a warrant to commit the petitioner/accused into the prison to undergo the sentence. 08.08.2022 1/3
