O R D E R
The present criminal original petition has been filed seeking direction to transfer the investigation in Crime No.209 of 2014 pending on the file of the first respondent to the second respondent.
2.The case of the petitioner is that the complainant's daughter viz.,Mrs.Saranya was married to one S.Ranganathan on 13.12.2013. While so, the said Saranya was suffered with typhoid fever and she was admitted in K.S.Hospital at A.G.S.colony, Velacheery on 07.03.2014. She was treated in the hospital till 11.03.2014 and she was under semi conscious state.
On 11.03.2014 at 08.00 p.m., the said Saranya was discharged from the hospital. When the petitioner questioned the reason for sudden discharge, the hospital authority had informed that she is on her way to recovery and she will gain conscious within 24 hours. After her discharge, she was taken to home. As she could not walk, again on 12.03.2014 at 08.00 a.m., she fell down and her condition got worsened, immediately she was taken to the same hospital viz., K.S. hospital, where the doctors declared that she was brought dead. Furthermore, the said Saranya was constantly harassed and tortured by her husband S.Ranganathan stating that he was having an illegal affair with another girl. Hence, the petitioner lodged a complaint on 12.03.2014 before the first respondent against the husband of the deceased Saranya and the hospital authorities.
On receipt of the complaint, the first respondent has registered a case in Crime No.209 of 2014. But, no action has been taken by the first respondent so far. Hence, the present criminal original petition is filed to transfer the case from the first respondent to the second respondent.
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
4. The learned Additional Public Prosecutor submitted that on receipt of the complaint of the petitioner, a case has been registered in Crime No.209 of 2014 under Sections 174(ii) of Criminal Procedure Code and the matter is pending for investigation.
5. In view of the submissions made by the petitioner as well as the Additional Public Prosecutor, this Court directs the first respondent to conduct investigation in the case in crime No.209 of 2014 and proceed further in accordance with law, as early as possible.
6. This criminal original petition is disposed of accordingly.
