Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 2nd respondent to dispose of the appeal filed by the petitioner in Na.Ka.No.49/2021/A3 dated 06.01.2021 on the file of the 2nd respondent in respect of the property in S.No.553/9, Siruthaur Village, Chengalpattu Taluk, Tirupporur, Kancheepuram District. ORDER

This writ petition has been filed seeking a direction to the 2nd respondent to consider the appeal.

2. According to the petitioner, he is the owner of the property in S.No.553/9, Siruthaur Village, Chengalpattu Taluk, Tirupporur, Kancheepuram District, to an extent of 08.0.0.20 cents and patta No.1379 was also granted in his favour. While being so, on 07.06.2017, the Deputy Zonal Tahsildar, due to oversight, wrongly included the name of one Krishnamoorthy in the patta No.1379, who is no way connected with this property. Since the Tahsildar, refused to delete the name of the said Krishnamoorthy in the patta, petitioner said to have filed an appeal before the 2nd respondent on 04.01.2021. Pursuant to the same, petitioner was called for enquiry on 08.03.2021 and he also appeared for enquiry. But, so far no order has been passed. . 3. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents.

4. Considering the facts and circumstances of the case and considering limited prayer sought for in the writ petition, and the petitioner's appeal dated 06.01.2021 is pending with the 2nd respondent, and enquiry has also been commenced, the 2nd respondent is directed to consider the petitioner's appeal and pass suitable orders, on merits and in accordance with law, after giving opportunity to the petitioner as well as the other interested persons, if any, within a period of six (6) weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. No costs.
