ORDER

This Civil Revision Petition has been filed, challenging the impugned docket order dated 20.01.2026 passed by the I Additional District Judge, Tiruppur in I.A. No.4 of 2025 in O.S. No.777 of 2023.

2.Under the aforesaid order, the Trial Court has allowed I.A. No.4 of 2025 filed by respondents 1 and 2/plaintiffs seeking to implead the petitioner as the fifth defendant in the suit O.S. No.777 of 2023 on the file of the I Additional District Judge, Tiruppur. During the pendency of the suit, the suit schedule property was settled in favour of the petitioner. On that ground, respondents 1 and 2/plaintiffs filed I.A. No.4 of 2025 seeking to implead the petitioner as the fifth defendant in the suit through I.A. No.4 of 2025. I.A. No.4 of 2025 was contested by the petitioner before the Trial Court opposing her impleadment as a party to the suit. The Trial Court, under the impugned order, however, rejected the said contention and has allowed I.A. No.4 of 2025 on the ground that the contentions raised by the petitioner have to be decided only after trial. The petitioner has challenged the impugned order through this petition. The impugned order is a speaking order and the Trial Court has rightly allowed I.A. No.4 of 2025.

3.Admittedly, the property now stands in the name of the petitioner and she claims ownership of the same through a Settlement deed having been executed subsequent to the filing of the suit O.S. No.777 of 2023 on the file of the I Additional District Judge, Tiruppur. Though the petitioner may have raised several grounds for challenging her impleadment in the suit as rightly pointed out by the Trial Court, they can be decided only after trial. Being a necessary party, the Trial Court has rightly allowed I.A. No.4 of 2025.

4.For the foregoing reasons, this Court does not find any infirmity in the reasons given by the Trial Court for allowing I.A. No.4 of 2025. In the result, this Civil Revision Petition is dismissed. Consequently, connected CMP is closed. No costs.
