ORDER

This petition is filed praying to direct the respondent to secure the sixth accused namely Anniyur Kumar cited in P.R.C.No.25 of 2012 pending on the file of the learned Judicial Magistrate No.1, Nagapattinam.

2.When the matter is taken up for consideration, the learned counsel appearing for the petitioner submitted that a nonbailable warrant is pending as against the sixth accused in P.R.C.No.25 of 2012 on the file of the learned Judicial Magistrate No.1, Nagapattinam for a long time and sought for a direction to the respondent police to secure the sixth accused. 3.The learned Additional Public Prosecutor submitted that originally case has been registered in Crime No.521 of 2004 for the alleged offence punishable under Sections 120-B, 264, 379, 302 and 201 of IPC and charge sheet has been filed. Since the sixth accused was absconding for a long time, the case was split up and so far as the sixth accused is concerned P.R.C.No.25 of 2012 has been assigned. Now, the respondent police are taking effort to secure the sixth accused namely, Anniyur Kumar. https://hcservices.ecourts.gov.in/hcservices/

4.I heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor. 5.Considering the submissions made on either side and since the matter is pending from the year 2012, this Court directs the respondent police to secure the sixth accused namely, Anniyur Kumar as early as possible. The Superintendent of Police, Nagapattinam is also directed to look into the matter with regard to the securing of the accused Anniyur Kumar. 6.With the above observation, this Criminal Original Petition is disposed of.
