PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to issue a direction to the respondent to give police protection to the Temple Festival on 15.05.2019 to 23.05.2019 at Sri Angalaparameswari Amman Kovil, Jakkampalayam, Aandiya Goundanoor Village, Madathukulam Taluk, Thiruppur District, based on the petitioner's representation dated 03.05.2019.

ORDER
This Criminal Original Petition has been filed to direct the respondent to give police protection to the Temple Festival from 15.05.2019 to 23.05.2019 at Sri Angalaparameswari Amman Kovil, Jakkampalayam, Aandiya Goundanoor Village, Madathukulam Taluk, Thiruppur District, based on the petitioner's representation dated 03.05.2019.

Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondent. 3.The learned counsel for the petitioner would submit that though there are two groups in the village, there was a peace committee meeting held in the presence of the Revenue Divisional Officer, Udumalpet, the Deputy Superintendent of Police, Udumalpet and the Inspector of Police, Madathukulam and in their presence, the parties have arrived at compromise and have agreed
to conduct the temple festival in a peaceful manner. He would further submit that the petition is thereby filed seeking for police protection to regulate the crowd and to conduct the festival without causing disturbance to the general public.

The learned Government Advocate appearing for the respondent would submit that permission was sought from 15.05.2019 to 23.05.2019 and she would submit that due to the elections, the respondent would be unable to provide sufficient police to regulate the crowd if the festival is conducted for nine days. However, she would submit that if the petitioner is prepared to restrict the temple festival to a period of five days i.e., till 20.05.2019, the respondent would be able to provide sufficient protection to the temple festival.
5. At this juncture, the learned counsel appearing for the petitioner would submit that the petitioner is willing to restrict the period of festival from 15.05.2019 to 20.05.2019.
6. Recording the same, the respondent is directed to provide police protection to the temple festival from 15.05.2019 to 20.05.2019. The organizers shall give an undertaking that they will abide by the peace committee resolution and also give an undertaking to the respondent Police that they will ensure safe conduct of the function without any disturbance to law and order. 7.It is open to the respondent police to impose any further restrictions or conditions purely in the interest of preserving public order and tranquility. In the event of the respondents incurring any expenses from shifting police force from elsewhere, the cost shall be borne by the organizers of the festival committee.
8. With the above directions, the Criminal Original Petition is disposed of. No costs.
