ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.03.2026 for the alleged offence under Sections 103(1) of BNS Act, 2023 and Section 302 of IPC in Crime No.23 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner suspected the conduct of his wife and that he frequently quarreled with his wife. On the alleged date of occurrence, the petitioner had stabbed his wife with some weapon and in the result, she sustained grievous injury and died. Hence, the present case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and that he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been in judicial custody since 05.03.2026 and he is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent Police strongly opposed the grant of bail to the petitioner on the ground that the petitioner has murdered his wife by stabbing her in the neck. He further submitted that the investigation is still in preliminary stage. Hence, he opposed the grant of bail to the petitioner. 2/4

5. Considering the totality circumstances of the case and also considering the nascent stage of the investigation, this Court is of the view that it is not an appropriate time to consider this bail application.
