(CR.NO.1 OF 2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition as the petitioners are directed to deposit a sum of Rs.1,98,000/ (Rupees one lakhs and ninety eight thousand only) by way of Demand Draft to the credit of Cr.No.1/2021, before the Judicial Magistrate No.I, Villupuram, without prejudice to their defence before the trial Court within a period of two weeks from the date of receipt of copy of this order and the Judicial Magistrate, after perusing the Demand Draft, shall accept the sureties furnished by the petitioners. Thereafter, the Judicial Magistrate is directed to disburse the amount of Rs.

1,98,000/- to the defacto complainant/ victim on filing of appropriate undertaking affidavit before the trial Court on the file of this Hon'ble court in Crl.OP.10869/21 order dated:25/06/2021 and thus render justice. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.N.VINOTHINI, Advocate for the Petitioner and of MR.C.E.PRATAP, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- The petitioners have filed this petition seeking to modify the conditional amount imposed in the order dated 25.06.2021 made in Crl.O.P.No.10869 of 2021.

2.Heard both sides.

3.The learned counsel appearing for the petitioners submitted that the amount imposed by this Court is exorbitant and the petitioners are poor persons and are not able to pay the amount and prayed to modify the condition.

4.The petitioners are alleged to have committed offence under Chit Fund Act apart from the offence under IPC. Hence, the conditional amount is just and reasonable one. 5.At this juncture, the learned counsel appearing for the petitioners seeks to grant further time to comply with the order dated 25.06.2021 made in Crl.O.P.No.10869 of 2021. 6.This petition is dismissed. However, considering the request made by the learned counsel appearing for the petitioners, time granted by this Court in the order dated 25.06.2021 made in Crl.O.P.No.10869 of 2021 is further extended by a period of two weeks from the date of receipt of a copy of this order. -sd/- 11/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
