A.No.2241 of 2022 in TOS. No.16 of 2006 A.A.NAKKIRAN, J.

This petition has been filed by the applicant/plaintiff to condone the delay of 1277 days in filing the restoration application against the order dated 14.11.2018 passed by the learned Judge in TOS.No.16 of 2016.

2. The learned counsel appearing for the applicant/plaintiff has submitted that due to the Covid-19 Pandemic situation, the applicant could not contact him.

3. The learned counsel appearing for the respondents/defendants has strongly opposed to allow this application.

4. Having been satisfied with the reasons stated in the affidavit filed in support of the application, in the interest of justice and that no prejudice would be caused to the respondents in allowing this application, this application is allowed on condition that the applicant pays a cost of Rs.2,000/- (Rupees Two Thousand only) to the Adyar Cancer Institute, Adyar, Chennai, on or before 26.07.2022. In the event of failure on the part of the applicants in paying the said amount within the stipulated time, this application shall stand dismissed automatically without any further reference to this Court.

5. Post the matter on 27.07.2022.
