The present criminal original petition has been filed seeking a direction to the respondent to register the petitioner's complaint dated 23.04.2015 and investigate the same in accordance with law.
2. In the petition, it has been stated that one Rajesh Kumar is the owner of the company namely, Trade Marketing Company for buying and selling of cars through marketing calls. Since the petitioner intended to sell his car bearing Registration No.TN07-AQ-9360, the said Rajesh Kumar approached the petitioner and promised him that he will sell the petitioner's car and settle the amount within a period of one month. Believing the said words, the petitioner handed over the car as well as the original RC Book and other relevant documents after executing an unregistered sale deed. when the petitioner contacted the said Rajesh Kumar over phone, he deliberately avoided to attend the call. When the petitioner went to his office to his shock and surprise, he found that the office locked. On enquiry with the neighbours, the petitioner found that the said Rajesh Kumar was in the habit of cheating others and then only, the petitioner had realised that he has been cheated by the accused. Hence, he lodged a complaint with the respondent police on 23.04.2015 to the Commissioner of Police, which was forwarded to the respondent herein. Since the same has not been registered, the petitioner is before this Court by way of filing the above Criminal Original Petition.
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
4. Learned Additional Public Prosecutor submitted that on the basis of the complaint, a case has been registered in Crime No.624 of 2015 for the offences under Sections 406, 420 of IPC.
5. Recording the submission of the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed. However, the petitioner is directed to co-operate for the enquiry.
