ORDER : The Court Made the following order :- The petitioner who was arrested on 09.05.2021 for the alleged offence under Sections 302 of IPC @ 147, 148, 341, 120(b), 302 of IPC in Cr.No.386 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that because of the business competition, the petitioner along with other accused persons, attacked the defacto complainant's husband and caused his death. On receiving information, the defacto complainant has lodged a complaint before the respondent Police.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate submitted that the petitioner is a habitual offender and there is one previous case pending against him. He further submits that this is the second bail application and the previous application was dismissed by this Court on 08.07.2021 in Crl.O.P.No.11758 of 2021. Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
