This Civil Miscellaneous Petition has been filed seeking to condone the delay of 166 days in filing the above Civil Miscellaneous Appeal against the award dated 27.06.2024 passed in M.C.O.P.No. 43 of 2020, on the file of Motor Accident Claims Tribunal/IV Addl. District Judge, Coimbatore.

2. Mr.C.Sathish, learned Government Advocate appearing for appellant submitted that after getting opinion from the Special Government Pleader, the appeal papers forwarded to the counsel on record and thereafter the appeal was filed on 19.03.2025, as a result of which, there is a delay of 166 days in filing the above Civil Miscellaneous Appeal arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Civil Miscellaneous Appeal.

3. Mr.K.Ayyadurai, learned counsel for 1st respondent appeared and raised formal objections for allowing this petition.

4. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition.
