O R D E R
The present criminal original petition has been filed to direct the respondent to conduct enquiry and complete the investigation in Crime No.13 of 2015 on the file of the respondent police and file Final Report or charge sheet in the appropriate court.
2. The case of the petitioner is that the petitioner herein has lodged a complaint as against one Subramani and others and the respondent has also registered a case in Crime No.13 of 2015 for the offences under section 147, 148, 294(b), 323, 324 and 506(ii) IPC. On the same incident, the respondent also registered an F.I.R. in Crime No.12 of 2015 for the offences under sections 147, 148, 294(b), 324 and 506(ii) IPC at the instance of one Subramani, S/o.Sundaramoorthy residing at Pillaiyar Koil Street, Kanal, Villupuram Taluk and District, as against the petitioner and 5 others. The respondent police has investigated the case in Crime No.12 of 2015 and has filed final report under sections 147, 148, 294(b), 352, 324 and 506(ii) IPC against the petitioner and others before the Judicial Magistrate https://hcservices.ecourts.gov.in/hcservices/
No.I, Villupuram and the same has been taken on file in C.c.No.131 of 2015 and the case is adjourned for trial. But in Crime No.13 of 2015, no investigation has been done and the respondent police is deliberately delaying the matter, without taking any action on the complaint given by the petitioner. Hence, the present criminal original petition has been filed.
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
4. In view of the submissions made on either side, this Court directs the respondent to expedite the investigation in Crime No.13 of 2015 and proceed further in accordance with law, as early as possible.
5. This criminal original petition is disposed of accordingly.
