Writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to dispose of the representation of the petitioner dated 05.09.2017 and to pass orders considering him for promotion to the post of Superintendent, within a short date that may be fixed by this Court.

O R D E R

The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the respondents 1 and 2 to dispose of the representation of the petitioner dated 05.09.2017, within a time stipulated by this Court.

Heard the learned Counsel for the petitioner and the learned Standing Counsel for the respondents. 3.

On the face of the records, this Court is of the view that the writ petition is liable to be dismissed because though by way of giving the representation dated 05.09.2017, the petitioner has sought for promotion to the post of Superintendent, the learned Counsel for the petitioner has not produced any rule fixing the criteria for promotion to see whether the petitioner has possessed the required qualification. When the petitioner has failed to satisfy this Court, no positive order can be passed. That apart, the petitioner has given the representation only on 05.09.2017. Therefore, this Court is unable to find any inaction on the part of the respondents.

In the result, the Writ Petition fails and the same is accordingly dismissed. No costs.
