O R D E R

The present criminal original petition has been filed seeking a direction to the respondent to register a case based on the complaint lodged by the petitioner dated 29.10.2015.

2. The petitioner herein was working as a personal secretary to the Managing Director, Bumi Geo Engineering Ltd., namely Mr.Jayakumar and due to her ill-health and family situation, she resigned from the said company in the year 2015 and handed over the documents and all the belongings of the company and she was also relieved from the said company vide letter dated 04.07.2015. Even thereafter, the said Jeyakumar threatened the petitioner and asked her to come and meet him along with her husband. Hence, she lodged a complaint as against Jeyakumar and Thangathambi on the allegation that the said counter petitioners threatened the petitioner over phone. It is further stated that on 27.10.2015, at around 05.45a.m, one Senthil, who happens to be the driver of Jeyakumar along with Thangathambi and three other unknown persons had trespassed into the house of the petitioner assaulted the petitioner and also threatened her and https://hcservices.ecourts.gov.in/hcservices/

abused her with filthy language. Hence, the petitioner lodged a complaint on 29.10.2015. Since no action was taken by the respondent till date, the petitioner came forward to file this petition.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the respondent.

4. The learned Additional Public Prosecutor submitted that on receipt of the complaint, C.S.R.No.1517 of 2015 has been assigned and the matter is pending enquiry.

5. Considering the rival submissions, this Court directs the second respondent to conduct an enquiry on the complaint given by the petitioner dated 29.10.2015, if enquiry was not conducted so far and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the second respondent is directed to proceed further in accordance with law, as early as possible.

6. The Criminal Original Petition is disposed of accordingly.
