These applications have been filed allowing the applicant herein to let in evidence by filing his proof affidavits in Application Nos. 53 and 54 of 2017 in I.P. No. 25 of 2014 and to receive the documents found in the list of documents to the present judges summons, as evidence along with the proof affidavits on the side of the second respondent in A. No. 53 of 2017 in I.P. No. 25 of 2014.

2. The said applications are strongly opposed by the Official Assignee on the ground that the application for recovery of money is pending since 2017 and after much difficulty, the petitioner herein, who is the second respondent was served, examination of witness commenced in the month of November, 2022. While so, after closing the petitioner's side witness, these petitions are filed to reopen, recall and adduce additional documents with sole intention to delay the process. Though the

records substantially support the submissions made by the learned counsel appearing for the Official Assignee, this Court is of the view in order to afford opportunity to the respondent, who is facing recovery proceedings, these applications are allowed on condition to pay a sum of Rs. 25,000/- on each application on or before 07.08.2024.
