The petitioner, who was arrested and remanded to judicial custody on 13.03.2023 for the offences punishable under Sections 506(ii) ( 3 counts) of IPC and Section 5(f), 5(i) read with Section 6, 21(2) of POCSO Act in crime No.154 of 2022 on the file of the respondent police, seeks bail.
2. It is seen that, there are totally two accused in this case, in which, petitioner is the first accused in this case. He was working as a Warden at ''Anbu Illam'' belong to St.Joseph School at Patthiyavaram. It is alleged that, petitioner had committed sexual assault on the minor victim boys, who were studying in the Anbu Illam. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. That apart, the petitioner has been suffering incarceration from 13.03.2023 Therefore, he prays to grant bail to the petitioner.
4. The learned Additional Public Prosecutor produced the statement of the victim boy recorded under Section 164 of Cr.P.C. However, he
vehemently opposed grant of bail to the petitioner.
5. On perusal of the statement of the victim body recorded under Section 164 of Cr.P.C revealed that there are three victim boys and they are sexually assaulted by the petitioner.
6. Considering the gravity of the offence committed by the petitioner as against the minor victim boys, this Court is not inclined to grant bail to the petitioner.
