Writ petitions filed under Article 226 of the Constitution of India for the issuance of writ of mandamus directing the second respondent to declare the tender result for the Shop No.8845 located at Plot No.8, Mogappair Road, Ambattur, Chennai - 53, Shop No.8720 located at No.140, Kamaraj Nagar, Avadi, Chennai - 54 and Shop No.8779 located at P.H. Road, Avadi, Chennai - 54 respectively and subsequently grant the license in favour of the petitioners for collecting empty bottles and to sell eatables in the bars attached to the said shops in case the petitioners emerge as the successful bidders.
For Petitioner : Mr.P.Rajkumar Pandian in all the W.Ps For Respondents : Mr.C.Kasirajan in all the W.Ps COMMON ORDER These writ petitions have been filed, seeking for a direction to the second respondent to declare the tender result for the Shop No.8845 located at Plot No.8, Mogappair Road, Ambattur, Chennai - 53, Shop No.8720 located at No.140, Kamaraj Nagar, Avadi, Chennai - 54 and Shop No.8779 located at P.H. Road, Avadi, Chennai - 54 respectively and subsequently grant the license in favour of the petitioners for collecting empty bottles and to sell eatables in the bars attached to the said shops in case the petitioners emerge as the successful bidders.
2.It is the case of the petitioners that the second respondent invited tenders for collecting empty bottles and to sell eatables in the bars and the petitioners also participated in the tender. The grievance of the petitioners is that though they submitted tenders to operate the bar, the said tenders are yet to be opened. 3.Heard the learned counsel appearing for the petitioners and the learned standing counsel for the respondents. 4.Learned standing counsel for the respondents, on instructions, would submit that since the petitioners were not present for the purpose of opening the tenders, the results were not declared and the second respondent is now inclined to open the tenders and declare the results accordingly.
5.In view of the above submission made by the learned counsel for the respondents, the petitioners are directed to appear before the second respondent on 10.09.2015 around 11 a.m. and on their appearance, the tenders shall be opened and necessary results shall be declared accordingly. The writ petitions are disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
