Writ Petition is filed under Article 226 of Constitution of India for writ of mandamus, directing the Respondents to restore the metro water connection provided to the Petitioner's premises bearing No. Q-58, Thirukurallar Street, MMDA Colony, Arumbakkam, Chennai-600106, vide CMC Bill No.03895 in Area VIII Division 108. O R D E R
The writ petitioner has filed the present writ petition alleging disconnection of Metro Water connection by the respondent board in the petitioner's premises and seeks direction to the respondent board for restoration of water connection.
2. Heard the learned counsel appearing for the petitioner and the learned standing counsel appearing for the respondents and perused the records.
3. It is seen from the records, at the time of admission, this Court directed the respondent board to restore the water connection to the petitioner's premises. Pursuant to the interim orders passed by this Court, the respondent had restored the Metro Water connection to the petitioner's premises
4. The learned standing counsel appearing for the respondent Board submitted that during inspection conducted by the officials of the respondent-Board at the petitioner's premises, it was found that the petitioner has misused the metro water supply given to his premises by installing a motor for drawing the water from the main pipe line, hence they disconnected the water supply connection. The learned standing counsel appearing for the respondent-Board has further submitted that Metro Water supply connection can be restored on payment of charges of Rs.29,500/- to the respondent board by the petitioner.
5. Recording the submissions made by the learned counsel appearing for the parties concerned, the following directions are issued;
i. Writ petitioner shall pay the charges of Rs.29,500/- to the respondent Board for restoration of water connection, within a period of four weeks from the date of receipt of a copy of this order, failing which, the respondent board shall take appropriate action against the petitioner, in accordance with law.
ii.It is open to the petitioner to approach the appropriate forum, if aggrieved by the orders passed by the respondent board.
iii.With the above directions, the writ petition stands disposed of.
No costs.
Consequently, connected Miscellaneous Petitions is closed.
