This application has been filed by the first defendant in the suit seeking to condone the delay of 546 days in filing the written statement along with the application.

2. The written statement of the 1st defendant has also been enclosed. The reasons given for the delay is that due to the corona pandemic and the lock down, the applicant / 1st defendant was unable to file the written statement within the prescribed period. Till date, no counter has been filed by the respondents/ plaintiffs.

3. This Court is satisfied with the reasons contained in the affidavit filed in support of this petition. Accordingly this application is allowed as prayed for.

4. Registry is directed to accept the written statement filed by the 1st defendant.

5. Fresh summons to the D3, returnable by 08.12.2021.
