This application has been filed by the 8th defendant in the suit seeking to condone the delay of 58 days in filing the written statement. 2.

In the affidavit filed in support of the Judge's Summons, it had been stated that due to illness, the applicant was not able to contact the counsel since 14.03.2020. Subsequently, due to Corona Pandemic and national lock down situation, they were not able to give the instructions to the counsel. It had been stated that now the instructions have been given and written statement has been filed, but however, there has been a delay of 58 days.

Learned counsel for the plaintiff is also present. 4.

Taking into consideration the fact that the defendant must also be given an opportunity to contest the case, delay is condoned and application stands allowed.
