PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus to call for the concerned records relating to the order of the first respondent dated 15.05.2002 passed in TSE No.61 of 2001 and quashed the same and consequently direct the 2nd respondent to reinstate the petitioner in service with full backwages, continuity of service and all other attendant benefits.

By consent of the learned counsel on either side, the writ petition is taken up for final disposal.

2. Heard Mr.Balan Haridas, learned Counsel appearing for the petitioner, Mr.S.Thambusamy, learned counsel for the first respondent and M/s Aiyar & Dolia, learned counsel appearing for the second respondent.

3.The learned counsel for the petitioner submitted that he has sent a communication to the petitioner and it is reported that the petitioner is no more and hence he is unable to proceed further in the matter.

4.The learned counsel appearing for the second respondent submitted that the lis does not survive for the legal heirs to agitate the matter.

5.However, at this stage this Court does not propose to express any opinion in the matter, leaving it open to the legal heirs to take appropriate steps in accordance with law.
