ORDER

The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 118(1), 3(5), 351(3) of BNS, Act @ 296(b), 118(1), 109(1) and 351(3) r/w 3(5) of BNS, Act in Crime No. 253 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner along with other accused trespassed the defacto complainant's house and attacked him with knife. Due to which, he sustained injuries and got admitted in the hospital. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed on him. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that this is the 4th anticipatory bail application and there is no change of circumstances in this case. He also submits that the petitioner is an history sheeter and four previous cases were pending against the petitioner in which all are similar in nature. He submits that A1 and A3 were enlarged on bail by the Trial Court. However, he opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the above facts and circumstances of the case , taking note of the submission made by the learned Government Advocate (Criminal Side), considering the fact that four previous cases were pending against the petitioner and also considering that this is the 4th anticipatory bail application and there is no change of circumstances in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
