Petition filed under Article 226 of the Constitution of India praying to issue a writ of habeas corpus directing the respondent to bring the produce the detenu by names Krishnaraj, aged about 45 years and Kalyani, aged about 37 years, now detained by the unknown persons before this Court and set them at liberty.

ORDER

[Order of the Court was made by M.M.SUNDRESH, J.] The petitioner, who is the father of the first detenu and father-in-law of the second detenu, has filed the present habeas corpus petition.

2.Learned Additional Public Prosecutor, placing reliance upon the counter affidavit filed, submitted that a criminal case has been registered pursuant to the complaint given by various persons for cheating in Crime No.17 of 2020. The petitioner was also arrested and thereafter released on bail. Apprehending arrest, his son and daughter-in-law along with the minor child are hiding. Now, efforts are being made to trace and apprehend the accused persons.

3.In view of the above, we do not find any reason to allow this habeas corpus petition. Admittedly, the detenus namely the son and daughter-in-law of the petitioner have been arrayed as accused and they are trying to escape from the clutches of law. 4.In such view of the matter, the habeas corpus petition stands dismissed. However, we make it clear that the dismissal of this habeas corpus petition will not stand in the way of the concerned police to proceed and secure the accused persons.
